1. Introduction

1.1 The Warehouse Collective Pty Ltd trading as Unleased (Unleased, we, us, our) operates the website at https://unleased.com.au/ and related services (the Platform), an online platform connecting businesses and individuals with small and shared warehouse space available for lease or licence (Hosts) with businesses and individuals looking for such space (Space Seekers).

1.2 We are committed to protecting the privacy of personal information handled through the Platform. This Privacy Policy explains what personal information we collect, how we collect it, how we use and disclose it, and how you can access, correct or ask questions about it.

1.3 This Privacy Policy has been prepared having regard to the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act). By using the Platform, you agree to the collection, use and disclosure of your personal information as described in this Privacy Policy.

1.4 This Privacy Policy should be read together with our Terms and Conditions. Terms defined in the Terms and Conditions (such as Host, Space Seeker, Listing and Host Agreement) have the same meaning here unless stated otherwise.

2. What personal information we collect

2.1 The personal information we collect depends on how you use the Platform, and may include:

  1. identity and contact information — name, business name, email address, phone number, and postal or billing address;
  2. account information — username, password (stored in encrypted form), account preferences and profile details;
  3. Listing information — details Hosts provide about a Space, including location, photographs, pricing and availability (Hosts must not include identifying or contact information within public Listing content — see clause 5 of our Terms and Conditions);
  4. communications — messages sent through the Platform’s messaging system between Hosts and Space Seekers, and correspondence with our support team;
  5. payment information — billing details and transaction records relating to listing fees paid by Hosts (payment card details are collected and processed by our third-party payment processor, Stripe, and are not stored by us — see clause 4);
  6. usage and technical information — IP address, device and browser type, pages viewed, search queries, referring URLs, and other data collected automatically via cookies and similar technologies (see clause 8); and
  7. other — any other personal information you choose to provide to us, for example in a support request, survey or feedback.

2.2 We only collect sensitive information (as defined in the Privacy Act) if you provide it to us voluntarily and with your consent, or where otherwise permitted by law. We do not require sensitive information to use the Platform.

3. How we collect personal information

3.1 We collect personal information directly from you when you register an Account, create or respond to a Listing, send a message through the Platform, make a payment, contact our support team, or otherwise interact with the Platform.

3.2 We may also collect personal information automatically through cookies, analytics tools and similar technologies when you use the Platform (see clause 8), and from third parties such as our payment processor, analytics providers, or, where you choose to use it, a third-party sign-in service (for example, Google sign-in).

3.3 Where reasonable and practicable, we will collect personal information directly from you. If we receive personal information about you from a third party (for example, from another user who mentions you in a message or complaint), we will take reasonable steps to ensure you are aware of the matters set out in this Privacy Policy.

4. Why we collect, use and disclose personal information

4.1 We collect, hold, use and disclose personal information for purposes including to:

  1. create and administer your Account and verify your identity;
  2. operate the Platform, including publishing Listings, enabling messaging between Hosts and Space Seekers, and facilitating introductions between them;
  3. process listing fees and other payments, and maintain billing records;
  4. provide customer support and respond to enquiries or complaints;
  5. monitor and enforce compliance with our Terms and Conditions, including the prohibition on including identifying information in Listings and on circumventing the Platform;
  6. improve, personalise and maintain the security of the Platform, including detecting and preventing fraud, abuse and unlawful activity;
  7. send you service-related communications (for example, account, Listing or transaction notifications) and, where you have consented or as otherwise permitted by law, marketing communications (see clause 7); and
  8. comply with our legal obligations, and establish, exercise or defend legal claims.

4.2 We do not sell personal information to third parties.

5. Who we disclose personal information to

5.1 We may disclose personal information to:

  1. other users of the Platform, but only to the extent necessary to facilitate an introduction — for example, once a Host and Space Seeker choose to identify themselves to one another through messaging, or as otherwise permitted under our Terms and Conditions;
  2. our service providers who help us operate the Platform, such as cloud hosting providers, payment processors, customer support tools, analytics providers and email or SMS delivery services, who are only permitted to use personal information to provide services to us;
  3. professional advisers, including lawyers, accountants and auditors, where reasonably necessary;
  4. a prospective buyer or acquirer of our business or assets, or their advisers, in connection with an actual or proposed business transaction, subject to appropriate confidentiality arrangements;
  5. regulators, law enforcement or other third parties where required or authorised by law, or to protect the rights, safety or property of Unleased, our users, or the public; and
  6. any other person with your consent.

5.2 We do not disclose the personal contact details a Host or Space Seeker provides during registration to other users except as described in clause 5.1(a). Users remain responsible for what they choose to disclose to one another once a conversation moves beyond the Platform’s messaging system.

6. Direct marketing

6.1 We may send you marketing communications about the Platform, offers or updates, where you have consented to receiving them or as otherwise permitted by law.

6.2 You may opt out of marketing communications at any time by using the unsubscribe link in the relevant communication or by contacting us using the details in clause 13. We will still send you service-related communications necessary for operating your Account, even if you opt out of marketing.

7. Overseas disclosure

7.1 Some of our service providers, including cloud hosting, payment processing and analytics providers, may store or process personal information outside Australia, including in EU, US, and Asia Pacific.

7.2 Where we disclose personal information to overseas recipients, we take reasonable steps to ensure those recipients handle personal information in a manner consistent with the Australian Privacy Principles, including through contractual protections, except where an exception under the Privacy Act applies (for example, where you have consented, or the disclosure is required by law).

8. Cookies and similar technologies

8.1 We use cookies and similar technologies to operate the Platform, remember your preferences, understand how the Platform is used, and improve its performance. This may include analytics tools such as Google Analytics.

8.2 Most browsers allow you to control or disable cookies through their settings. If you disable cookies, some features of the Platform may not function properly.

9. Storage and security

9.1 We take reasonable technical and organisational steps to protect personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure, including access controls, encryption of passwords and payment data (handled by our payment processor), and restricting access to personal information to personnel who need it.

9.2 No method of transmission or storage is completely secure. While we take reasonable steps to protect personal information, we cannot guarantee its absolute security.

9.3 We retain personal information for as long as reasonably necessary to fulfil the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we take reasonable steps to destroy or de-identify it, unless we are required by law to retain it for longer.

10. Access and correction

10.1 You may request access to the personal information we hold about you, and request that we correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading, by contacting us using the details in clause 13.

10.2 We will respond to access and correction requests within a reasonable period. We may need to verify your identity before providing access or making corrections. In some circumstances permitted by the Privacy Act, we may decline a request for access or correction, and if we do, we will provide reasons where required by law.

10.3 There is no charge for making a request, though we may charge a reasonable fee for giving access to personal information where permitted by law.

11. Children’s information

The Platform is not directed at, and we do not knowingly collect personal information from, children under the age of 18. Consistent with clause 4.2 of our Terms and Conditions, you must be at least 18 years old to register an Account.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time by posting the updated version on the Platform, with the “last updated” date revised accordingly. Where changes are material, we will use reasonable endeavours to notify registered users. We encourage you to review this Privacy Policy periodically.
